I. TYPE OF PRACTICE
The firm practices civil litigation in both federal and state courts, and transactional matters. Its practice includes the prosecution and defense of cases involving contract disputes, real estate disputes, municipal disputes, violations of the Texas Insurance Code (first party insurance cases both defense and plaintiff), insurance coverage disputes including coverage opinions, violations of the Texas Deceptive Trade Practices Act, breaches of fiduciary duty, debtor-creditor disputes and family law disputes. Transactional matters practiced by the firm’s transactional department include real estate transactions, probate transactions and commercial transactions.
II. SCOPE OF PRACTICE
The firm primarily practices geographically within the State of Texas in both state and federal court. The bulk of its work is in the Rio Grande Valley of Texas. Outside of the State of Texas, the firm only practices in federal court.
III. THE RIO GRANDE VALLEY OF TEXAS
The United States District Court for the Southern District of Texas, McAllen Division, and the state District Courts of Texas for the McAllen, Edinburg, Mission Metropolitan Statistical Area are found in Hidalgo County. Hidalgo County, Texas is located in the Rio Grande Valley of South Texas and borders The Republic of Mexico on its Southern side. Hidalgo County's most populated area is the McAllen-Edinburg-Mission Metropolitan Statistical Area (hereinafter referred to as MEMMSA). It is the fastest growing area in Texas and one of the fastest growing areas in the nation. The median age for females is 28. Hidalgo County has an approximate population of 550,000 people.
The MEMMSA has the thirteenth highest population of Hispanic residents in the country numbering 367,400. The percentage of the population in the MEMMSA of Hispanic origin is approximately 80 percent.
Hidalgo County currently has an unemployment rate of approximately 8 percent. Most of these unemployed fall into the category of unskilled workers. The ten largest employers in Hidalgo County include the City of McAllen, the Edinburg Consolidated Independant School District, H.E.B. Food & Drug Stores, McAllen Independant School District, the McAllen Medical Center, the Mission Consolidated School District, Pharr-San Juan-Alamo Independant School District, Wal-Mart Stores, the Weslaco Independant School District and the La Joya Independent School District.
Located with the MEMMSA is the University of Texas - Pan American in Edinburg, Texas. UTPA is one Texas' fastest growing universities in Texas. It ranks first nationally in the number of Bachelors degrees in education awarded to Hispanics. On June 1, 1993, South Texas College was created in McAllen, Texas and it is growing at a blistering pace.
Although there has been a tremendous increase in Fourtune 500 Companies moving their manufacturing and assembly plants to Hidalgo County, the County still has a large Agribusiness Economy.
In the past juries in Hidalgo County tended to award liberal verdicts. However, that has changed. There appears to have been a mitigating effect in the last couple of years as jurors have been educated as to the consequences of awarding large verdicts.
All things being equal, the state district court judges will usually side with the Plaintiffs' bar. However, the federal court system in Hidalgo County is much more conservative and in most cases is fair in its rulings and damage awards. Federal Court in Hidalgo County is a much more favorable forum for civil defendants.
